1. Acceptance of Terms
By engaging So Flow Pool Services LLC ("Company," "we," "us," or "our") for pool cleaning and maintenance services, you ("Customer," "you," or "your") agree to be bound by these Terms & Conditions. These terms constitute a legally binding agreement between you and So Flow Pool Services LLC.
2. Services Provided
2.1 Weekly Pool Cleaning Services Include:
Surface skimming and debris removal
Bottom vacuuming as needed
Wall and tile brushing
Emptying skimmer and pump baskets
Water chemistry testing and balancing
Chemical application and adjustments
Visual equipment inspection
Monthly filter cleaning (every 4 weeks)
2.2 Service Areas: East Delray Beach, East Boca Raton, Highland Beach, Ocean Ridge, and Gulf Stream, Florida.
2.3 Service Schedule: Service is provided 48 weeks per year (not 52 weeks), with 1 planned week off in May and 1 planned week off in November. Advance notice will be provided for planned service interruptions.
2.4 Service Scope:
We are a service company, not an advisory company
We clean pools weekly, add chemicals, and make suggestions
We are not responsible for all pool conditions or outcomes
Weekly photos and chemical readings are not included in standard service
3. Pricing and Payment Terms
3.1 Monthly Billing:
Service is billed monthly in advance
Payment is due before the 15th of each month
Late fee of $25 applies if payment is not received by due date
Credit card on file is preferred for automatic billing
3.2 Additional Services:
Stabilizer Treatment: $85 (January and July) - $170/year total
Salt for Salt Pools: $15 per bag as needed
Salt Cell Cleaning: $85-95 every 3-6 months
Water Adding/Draining: $50-125 (30-minute maximum)
Quad Filter Cleaning: Extra charge beyond standard filter cleaning
Hurricane Cleanup: $50-250 depending on scope
Pressure Cleaning: Additional service pricing
Landscaping Cleanup: Additional service pricing
3.3 Equipment Installation and Repair:
50% down payment required
Remaining 50% due upon completion
Final invoice sent if service is cancelled to cover completed work
3.4 Payment Terms:
All payments are final
Annual or bi-annual payment discounts available upon request
Credit card on file required for automatic billing
3.5 Price Changes: Pricing is subject to change with 30-day written notice.
4. Customer Responsibilities
4.1 Property Access:
Ensure clear, safe access to pool area during scheduled service times
Provide gate codes, keys, or other access methods as needed
Notify us immediately of any access changes
4.2 Equipment and Safety:
Maintain pool equipment in working condition
Ensure adequate water levels for proper equipment operation
Remove any hazardous materials or obstructions from pool area
4.3 Communication:
Report equipment problems or service concerns promptly
Provide current contact information for billing and service coordination
5. Service Limitations and Disclaimers
5.1 Scope of Service:
We are a service company providing cleaning and basic maintenance
We do not guarantee specific water conditions or equipment performance
We are not responsible for existing equipment defects or failures
Pool condition depends on multiple factors beyond our weekly service
5.2 Equipment Repairs:
We are currently working toward obtaining our CPC license for repairs
Until then, equipment repair recommendations will be provided
Repairs must be performed by licensed professionals
We are not liable for equipment failures or pre-existing conditions
5.3 Weather and Environmental Factors:
Service may be rescheduled due to severe weather conditions
Heavy rains, storms, and environmental factors may affect pool condition between visits
Additional treatments may be required during extreme weather events
6. Liability and Insurance
6.1 Insurance Coverage: So Flow Pool Services LLC maintains appropriate liability insurance and bonding as required by Florida law.
6.2 Limitation of Liability:
Our liability is limited to the monthly service fee
We are not responsible for pre-existing pool or equipment conditions
We are not liable for damage caused by equipment failure, acts of nature, or third parties
Customer assumes responsibility for maintaining adequate property insurance
6.3 Property Damage: Any damage caused by our negligence during service will be addressed according to our insurance coverage and Florida law.
7. Service Guarantee and Cancellation
7.1 Satisfaction Guarantee: If you are not satisfied with our service, we will return within 24 hours to address your concerns at no additional charge.
7.2 Cancellation Policy:
Month-to-month service with no long-term contracts required
Either party may cancel service with notice before the next scheduled service
Notification required before your next scheduled service for cancellation
Final billing will be prorated based on services performed
7.3 Service Termination: We reserve the right to terminate service for non-payment, safety concerns, or breach of these terms.
8. Force Majeure
We are not liable for delays or inability to perform services due to circumstances beyond our control, including but not limited to: natural disasters, government restrictions, equipment failures, or other acts of God.
9. Privacy and Data Protection
9.1 Information Collection: We collect only necessary information for service delivery and billing purposes.
9.2 Information Use: Customer information is used solely for service provision and will not be shared with third parties except as required for service delivery or legal compliance.
10. Dispute Resolution
10.1 Governing Law: These terms are governed by the laws of the State of Florida.
10.2 Jurisdiction: Any disputes will be resolved in the appropriate courts of Palm Beach County, Florida.
10.3 Alternative Resolution: Both parties agree to attempt resolution through good faith negotiation before pursuing legal action.
11. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
12. Modifications
These terms may be modified only by written agreement signed by both parties. Continued service after notification of changes constitutes acceptance of modified terms.
13. Entire Agreement
These Terms & Conditions, along with any signed service agreement, constitute the entire agreement between the parties and supersede all prior agreements or understandings.
14. Florida-Specific Compliance
14.1 Licensing: So Flow Pool Services LLC operates in compliance with all Florida Department of Business and Professional Regulation requirements for pool service companies.
14.2 Chemical Handling: All chemical handling and application is performed in accordance with Florida Department of Health regulations and manufacturer specifications.
14.3 Environmental Compliance: Services are performed in compliance with Florida environmental protection laws and local ordinances.
